1. Agreement

1.1 Who these terms are with

These terms are between you and TNAADO Inc., a corporation organized under the laws of Ontario, Canada, 1050 King Street West, Toronto, Ontario, Canada M6K 0C7 ("TNAADO", "we", "us"), which publishes TNAADO Travel at travel.tnaado.ca (the "Site"). They were last updated on 26 October 2026.

1.2 Acceptance

By using the Site you accept these terms. If you do not accept them, do not use the Site. The Privacy Policy, Disclaimer and Cookies and advertising notice also apply to your use.

1.3 Your statutory rights

Nothing in these terms limits any right you have under applicable law that cannot be waived or limited by agreement, including consumer protection law. Section 5.4 says how.

2. Nature of the service

2.1 Free and experimental

The Site is a free information site with border-crossing guides, live wait-time displays, calculators and checklists, in English and Spanish. It is offered free of charge as an experimental public-information project. It is not a paid service, a product you bought or a subscription.

2.2 No service-provider or client relationship

Because the Site is free, you pay us nothing and we have not agreed to provide you with any service, support, level of availability, accuracy or result. Using the Site does not make TNAADO your service provider, adviser, agent or fiduciary, and does not create a client, lawyer-client or other professional relationship. We do not owe you the contractual duties, service standards or warranties that a paid service provider would owe you under a contract for services.

2.3 We may change or stop it

We may change, correct, suspend, restrict or remove any page, tool or feature, or the whole Site, at any time and without notice.

3. No professional advice

Everything on the Site is general information. It is not legal, customs, immigration, tax, financial or other professional advice, and it does not take account of your own circumstances. TNAADO is not a law firm and does not provide legal services. Ask a licensed or qualified professional who is accountable to you before you act on anything that matters. See the Disclaimer.

4. Accuracy and availability

4.1 As is, as available

To the fullest extent permitted by law, the Site and everything on it are provided "AS IS" and "AS AVAILABLE", without warranties or conditions of any kind, express or implied, including any warranty or condition of accuracy, completeness, currency, merchantability, fitness for a particular purpose, non-infringement or uninterrupted or error-free operation.

4.2 May be wrong or out of date

Content can be wrong, incomplete or stale, and rules, rates, fees and policies change, sometimes without notice and sometimes retroactively. This includes the live wait-time and similar data feeds. Verify anything that matters at the official CBP or CBSA page, posted signs and the border officer's instructions before you rely on it.

4.3 Corrections

If you think a page is wrong, email contact@tnaado.ca with the page address and a link to the official source that disagrees. We review corrections but are not obliged to make any change.

5. Limitation of liability

5.1 The limit

To the fullest extent permitted by law, TNAADO Inc. and its directors, officers, employees and contractors are not liable to you for any loss or damage arising out of or in connection with the Site, its content or tools, or your use of or inability to use them, whether the claim is in contract, tort (including negligence and negligent misrepresentation), statute or otherwise. Because the Site is free, our total liability to you for all claims together is limited to the amount you paid us to use the Site, which is nil. If a court decides that a nil limit is not allowed, our total liability is limited to CAD $100.

5.2 Losses we exclude

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of profit, revenue, business, data, goodwill or opportunity, or for losses such as denied entry, a missed or delayed crossing, flight or appointment, duties, taxes, fines or the seizure of goods, even if we were told they were possible.

5.3 What this section does not limit

Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded or limited. These limits apply only as far as the law of the place whose law governs the claim allows.

5.4 Consumers

If you are a consumer, the consumer protection law of the place where you live may give you rights that apply despite these terms. In Ontario, the Consumer Protection Act, 2002 provides that its rights apply despite any agreement or waiver. We do not say that it applies to use of a free site, but if it or any similar law does apply to you, nothing in these terms waives or reduces those rights, and where a term here conflicts with a right you cannot waive, the right prevails.

6. Assumption of risk and reliance

You use the Site at your own risk. You acknowledge that the Site is free and experimental; that it may contain errors; that you will check anything that matters against the official source and, where appropriate, with a qualified professional; and that it is not reasonable to rely on the Site alone for a decision with legal, financial, tax, health, safety, immigration, customs or travel consequences. If you rely on the Site without doing so, you do so at your own risk. This section does not apply to the extent that the law will not let us rely on it, and it does not excuse fraud.

7. Permitted use

We give you a limited, non-exclusive, non-transferable, revocable licence to view the Site in a web browser and use its tools for your own personal, non-commercial, informational purposes. You may follow and share links to its pages. Reading a guide or running a calculator to help you make a decision about your own affairs is permitted; the risk provisions of these terms still apply to it.

8. Prohibited commercial use and reproduction

8.1 What is not allowed

Without our prior written permission, you may not use, or help anyone else use, the Site or its guides, wait-time displays and the way they are compiled, calculators, checklists and underlying data files for any commercial purpose, or reproduce them. In particular you may not:

  • sell, license, rent, sublicense or otherwise monetise the Site or any part of it;
  • republish, mirror or copy whole pages, large parts of the Site or its compilation, or present our content as your own;
  • scrape, crawl, harvest or bulk copy the Site, or use bots, scripts or other automated means to send queries or requests, beyond the ordinary browsing of a person using a normal web browser, or crawling that our robots.txt file allows by a search engine, answer engine or the advertising and analytics services the Site uses (which may index, summarise and link to the Site but not use it for the training described below);
  • frame, embed, white-label or re-brand the Site or any tool, or include it in a product or service that you charge for or that earns you revenue;
  • use the Site or its content to train, fine-tune or test a machine-learning or artificial-intelligence model, or to build a dataset, database or competing product;
  • circumvent any technical measure, rate limit or access control, or interfere with the Site or its hosting; or
  • remove, hide or change any disclaimer, notice, attribution or ad label.

8.2 What this does not restrict

These terms do not restrict quoting a short excerpt with attribution and a link back to the page; any fair dealing allowed by the Copyright Act (Canada), any fair use allowed by United States copyright law, or any other use that the law permits despite a contract term; or your use of facts, official figures and third-party material that we do not own, which remain available from their original sources.

8.3 Our remedies

We may block, rate-limit or suspend access, and may take any other action the law allows, if we think you have breached this section. The licence in the previous section ends automatically if you do.

9. Commercial-use indemnity

If you use the Site or its content in breach of "Permitted use" or "Prohibited commercial use and reproduction", or in the course of a business or for profit with our permission, you are responsible for your own losses and you agree to reimburse TNAADO Inc. for losses, damages and reasonable legal costs it suffers from a claim by a third party to the extent that claim arises from that use. This section does not apply to personal, non-commercial use and does not apply to the extent the law does not allow it.

10. Intellectual property and trademarks

The text, design, source code and compilation of the Site belong to TNAADO Inc. or its licensors and are protected by copyright and other laws. Except for the licence above, we grant you no rights in them. "TNAADO" and the TNAADO mark are trade names of TNAADO Inc. and may not be used without written permission. Names, marks and logos of governments, agencies, retailers and other third parties belong to their owners. We use their names only to refer to them, and that use does not mean they are affiliated with, endorse or sponsor us.

10.1 Copyright complaints

If you believe something on the Site infringes your copyright, email contact@tnaado.ca with "Copyright" in the subject line and give: the work you say is infringed; the address of the page; your name and contact details; a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law; and a statement that the information in your complaint is accurate and that you are the owner or authorized to act for the owner. We review complaints and may correct or remove content. The Site hosts no content submitted by visitors, and we have not set up a designated-agent takedown process for the United States or Canada. If visitor content is ever added, we will need to review that with a lawyer first.

11. Third-party links, data and advertising

11.1 Links and data

Pages link to third-party sites and sources. We do not control them and are not responsible for their content, availability, accuracy or privacy practices. Pages cite and link to government sources, and wait times come from third parties. U.S. Customs and Border Protection (CBP), the Canada Border Services Agency (CBSA), the U.S. Department of Homeland Security, the Transportation Security Administration and other agencies named on the Site are not affiliated with us and do not endorse us.

11.2 Advertising

The Site shows advertisements served by Google AdSense, labelled "Advertisement". We do not select, review or endorse individual advertisers, and any dealings you have with an advertiser are between you and the advertiser. See Cookies and advertising.

11.3 Affiliate links

We do not currently use affiliate links. If a page ever contains a link for which we may be paid, we will say so next to the link.

12. Changes

We may update these terms by posting a new version on this page with a new date. Your continued use of the Site after a change means you accept the updated terms; if you do not accept them, stop using the Site.

13. Governing law and venue

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Subject to the next paragraph, the courts of Ontario sitting in Toronto have jurisdiction over disputes about these terms or the Site.

These terms contain no arbitration clause and no waiver of your right to bring or join a class proceeding. If you are a consumer, nothing in these terms removes any right you have under mandatory consumer protection law or other mandatory law, including any right to bring a claim in the courts where you live.

14. Severability and general

If a court finds part of these terms unenforceable, that part applies as far as the law allows and the rest stays in force. Our failure to enforce a term is not a waiver of it. These terms and the documents they refer to are the whole agreement about your use of the Site.

15. Contact

16. Sources and basis

  • Consumer Protection Act, 2002 (Ontario), read at ontario.ca/laws/statute/02c30 on 26 October 2026: s. 1(1) a "consumer agreement" is one in which the supplier supplies goods or services "for payment" (or rewards points), so a free site may fall outside it, although s. 2(1) applies the Act to all consumer transactions with Ontario consumers; s. 7(1) rights apply despite any agreement or waiver; s. 7(2) and s. 8 arbitration and class-proceeding terms cannot override consumer rights; s. 9(1) and (3) the deemed warranty that services are of reasonably acceptable quality cannot be negated, but only for services under a consumer agreement. The Act is to be repealed on a day set by proclamation, when the Consumer Protection Act, 2023 (S.O. 2023, c. 23, Sched. 1, not in force on 26 October 2026) replaces it; re-check on proclamation.
  • Tercon Contractors Ltd. v. British Columbia, 2010 SCC 4: an exclusion clause is enforced if it covers the facts, was not unconscionable when made and is not overridden by public policy. Known from secondary summaries; the decision itself was not retrieved.
  • Hedley Byrne & Co. v. Heller & Partners [1964] AC 465 and Queen v. Cognos Inc., [1993] 1 SCR 87: liability for negligent misstatement, and the effect of a disclaimer on reasonable reliance. Not retrieved.
  • Copyright Act (Canada), ss. 29, 29.1 and 29.2 (fair dealing), read 26 October 2026; 17 U.S.C. 107 (fair use).
  • Van Buren v. United States, 593 U.S. 374 (2021), read 26 October 2026: the Court left open whether contract or policy limits matter under the Computer Fraud and Abuse Act. A website term is therefore enforced mainly as a contract, not as a crime.
  • Rudder v. Microsoft Corp. (1999), 106 O.T.C. 381 (Ont. S.C.J.): online terms accepted by clicking were enforced. Known from secondary summaries. These terms are accepted by using the Site, not by a click, and courts enforce that less readily; clear notice of the terms on every page helps.
  • Uniform Commercial Code 2-316(2) and (3)(a), read 26 October 2026: "as is" language, conspicuous, excludes implied warranties of goods in the United States.
  • Trademark names are used in plain text only to refer to the real entity (nominative fair use, 15 U.S.C. 1125(c)(3)(A)).
  • Governing law and venue follow the choices published in TNAADO Inc.'s terms at tnaado.ca/terms. A free site may not be a consumer agreement at all, and a limit on liability cannot stop a court from applying mandatory law, deciding a clause is unconscionable or contrary to public policy, or finding a duty of care. Not reviewed by counsel; the liability limit, indemnity and commercial-use ban are general forms for counsel to settle: see the notice at the top of this page.
